Americans For Non-Profit Transparency ("AFNPT," "we," "us," or "our") is committed to protecting the privacy of visitors to our website, afnpt.org (the "Site"). This Privacy Policy explains what information we collect, how we use it, and your rights regarding that information. This policy complies with the California Online Privacy Protection Act (CalOPPA), and where applicable, the California Consumer Privacy Act (CCPA), Colorado Privacy Act, Oregon Consumer Privacy Act, and other state privacy laws.
1. Information We Collect
Information You Provide Voluntarily
- Contact information (name, email) if you submit a tip, contact us, or subscribe to updates
- Donation information processed through our third-party payment processor (Stripe)
- Any information you voluntarily include in communications with us
Information Collected Automatically
- Browser type, operating system, and device information
- IP address (anonymized where possible)
- Pages visited, time spent, and referring URLs
- Cookies and similar tracking technologies (see Section 5)
Information We Do NOT Collect
- We do not sell personal information to any third party
- We do not collect credit card numbers directly — all payment processing is handled by Stripe (PCI DSS Level 1 certified)
- We do not track visitors to our Secure Tips page (all analytics scripts are removed from that page)
2. How We Use Your Information
- To operate and improve the Site
- To respond to inquiries and tips
- To process donations and issue tax-deductible receipts as required by IRS regulations
- To send newsletter updates (only with your explicit opt-in consent; you may unsubscribe at any time)
- To comply with legal obligations
- To protect the security and integrity of the Site
3. Information Sharing
We do not sell, rent, or trade your personal information. We may share information only in the following limited circumstances:
- Service providers: Payment processing (Stripe), email delivery, and website hosting, under contractual data protection obligations
- Legal requirements: When required by law, subpoena, or court order — we will challenge compelled disclosure of source information to the fullest extent permitted by applicable shield laws
- Organizational transfers: In the event of a merger or organizational restructuring, with equivalent privacy protections
4. Donor Privacy
AFNPT respects the privacy of our donors. Consistent with the Supreme Court's ruling in Americans for Prosperity Foundation v. Bonta (2021), which held that compelled donor disclosure burdens First Amendment associational rights:
- We will never sell or share donor lists with any third party
- Donor names will not be published without explicit written consent
- We maintain donor information only as required for IRS compliance and tax-deductible receipt issuance
- Schedule B contributor information is not included in any public disclosures, consistent with IRS public charity rules
5. Cookies and Tracking Technologies
The Site uses cookies for essential functionality (session management, security) and optional analytics. You may disable cookies through your browser settings. We honor Do Not Track (DNT) browser signals.
Third-party cookies: If we use analytics services, they operate under their own privacy policies. We minimize third-party tracking and do not use advertising cookies.
6. Your Rights
Depending on your jurisdiction, you may have the following rights:
- California residents (CalOPPA/CCPA): Right to know what personal information is collected, right to request deletion, right to opt out of sale (we do not sell data), right to non-discrimination for exercising privacy rights
- Colorado, Oregon, Delaware, Maryland residents: Similar rights to access, correct, and delete personal data where applicable under your state's privacy law
- All visitors: Right to unsubscribe from communications, right to request information about data practices

7. Data Security
We implement reasonable administrative, technical, and physical security measures to protect personal information. All data transmitted to our Site is encrypted via TLS/SSL. Payment data is processed by Stripe under PCI DSS Level 1 compliance — card information never touches our servers.
8. Children's Privacy
The Site is not directed to children under 13. We do not knowingly collect personal information from children. If we learn that we have collected information from a child under 13, we will delete it promptly.
9. Data Retention
We retain personal information only as long as necessary for the purposes described in this policy:
- Contact information from tips: Retained for the duration of the investigation plus 3 years, then securely deleted unless the source requests earlier deletion
- Donation records: Retained for 7 years as required by IRS regulations for tax-deductible contributions
- Newsletter subscriptions: Retained until you unsubscribe, then deleted within 30 days
- Analytics data: Aggregated and anonymized within 26 months
- Server logs: Retained for 90 days for security purposes, then deleted
10. Do Not Sell My Personal Information
AFNPT does not sell personal information. We have never sold personal information and have no plans to do so. Under the California Consumer Privacy Act (CCPA), you have the right to opt out of the sale of your personal information.
Although we do not sell personal information, if you wish to exercise your rights under CCPA or submit a verifiable consumer request, contact us at privacy@afnpt.org with the subject line "CCPA Request."
We will respond to verified requests within 45 days as required by law.
11. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be posted on this page with an updated effective date. Continued use of the Site after changes constitutes acceptance of the revised policy.
