Registration Act
The Foreign Agents Registration Act (22 USC 611) requires persons acting as agents of foreign governments to register with the DOJ. Who Must Register
Any person who acts as an agent of a foreign principal in a political or quasi-political capacity, including those who engage in political activities, public relations, or dissemination of informational materials on behalf of a foreign government or political party.
What Must Be Disclosed
The identity of the foreign principal, the nature and scope of the registrant's activities, all compensation received, and all informational materials disseminated. Short-form registrations are available for certain exempt categories.
The 614(b) Label Requirement
All informational materials distributed by a FARA registrant must include a clear and conspicuous statement identifying the distributor as a foreign agent and identifying the foreign principal on whose behalf the materials are distributed.
Criminal Penalties (22 USC 618)
Willful violation of FARA is a felony punishable by up to five years in prison and/or a $10,000 fine. The DOJ may also seek civil injunctions and require corrective disclosure of prior undisclosed materials.

Does FARA apply to media companies?
FARA applies to any person acting as an agent of a foreign principal, including media activities. The key question is whether the media activity is undertaken at the direction of or in consultation with a foreign principal. If a media company's CSO is a registered foreign agent who has contracted to integrate content into that network on behalf of a foreign government, the disclosure requirements of 22 USC 614(b) may apply to that content.
What exemptions exist under FARA?
FARA provides several exemptions including: (1) activities of diplomatic personnel; (2) activities solely in a private and non-political capacity; (3) activities of lawyers engaged in legal representation; (4) activities of bona fide religious, scholastic, or scientific pursuits; and (5) activities of news media organizations. However, the news media exemption under 22 USC 613(f) has specific requirements and does not apply when the media activity is undertaken at the direction of a foreign principal.
