The seven charges

These are the counts in the charging document, called an Information. The text under each count restates what the State alleges. An allegation is what prosecutors must prove at trial.

    First-degree felonyUtah Code § 76-11-210

The State alleges: That he fired a gun in Kirk's direction and that the act caused serious bodily injury.

  3. Count 3

    Obstruction of justice

    Second-degree felonyUtah Code § 76-8-306

What else the charging document says

Possible penalty. The document states that a conviction for aggravated murder “may carry the death penalty,” or a term of life without parole, or a term of not less than 25 years that may be for life. The Utah County Attorney's Office has said it intends to seek the death penalty.

Victim targeting. On three of the counts the State also alleges that Kirk was selected because of his political expression. If a jury finds that proven, the sentencing judge or the parole board must consider it as an aggravating factor.

What it is not. A charging document sets out what the State intends to prove. It is not evidence and it is not a verdict.

What a preliminary hearing decides

The hearing held July 6 to 10, 2026 asked one question: is there enough evidence for the case to go to trial? On September 1, 2026 Judge Tony Graf ruled that there is, on every count. That ruling does not decide guilt. A trial does.
